A $60,000 Settlement for Trip and Fall on a Brooklyn Sidewalk

A middle aged woman was walking on a sidewalk in Brooklyn when she tripped and fell on a defective sidewalk. The woman sustained injuries to her right hand and wrist and ultimately required surgery. The woman sought compensation for her injuries and contacted The Schlitt Law Firm to retain an attorney experienced with cases involving a trip and fall on a Brooklyn sidewalk. Our client was very pleased with the settlement we obtained in her case.

New York City law states that the property owner of the land immediately adjacent to the sidewalk is responsible for the sidewalk. This law applies to removing snow and ice as well as the general physical condition of the sidewalk. Therefore, the adjacent property owner bears liability for a trip and fall on the sidewalk. We notified the owner of the property where our client fell that she had a claim against them. When we did not receive a response to our claim letter, we filed a lawsuit to force a response from the property owner and their insurance company. With this action we were able to open a line of communication with the defendant and their insurance company.

Investigating this a Trip and Fall on a Brooklyn Sidewalk Case

We investigated the site of our client’s trip and fall on a Brooklyn sidewalk, taking pictures of the property and the adjacent sidewalk where our client tripped and fell, documenting the hazard as the cause of our client’s trip and fall. During this same time, we collected our client’s medical records. Our client was diagnosed with sprains and tenosynovitis to her right hand and wrist. We kept a careful record of her medical treatment, collecting her records from her physical therapy treatment and her surgery that addressed the damage to her wrist. After we collected her complete medical records, our Nurse prepared a full chronology and summary of her injuries and treatment.

Having this complete medical review of our client’s recovery allowed us to prepare a thorough Case Assessment for our client. This Case Assessment included our Nurses’ Review, a detailed analysis of the liability and the damages in this case. This Case Assessment allows us to review all aspects of our client’s case with them so that we can propose to settle the case with the defendant’s insurance company.

Negotiating a Settlement for this a Trip and Fall on a Brooklyn Sidewalk Case

Having gotten the defendant’s attention with a lawsuit, we sent a Settlement Proposal to their insurance company. Our Settlement Proposal presents the strongest possible case to the defendant’s insurance company. This report includes our analysis of liability, our assessment of damages, which includes our Nurses’ Medical Review, and our settlement demand. The insurance company’s initial offer was too low, but after rigorous negotiation and presentation of our analysis of the case, we obtained a settlement that was agreeable to our client. Our client was very happy to resolve the case and receive compensation.
